It is possible you can approach the forum on the date fixed and request that you wish to withdraw the matter and tell them the constraints. Consumer forums do not follow a strict procedure of the CPC and therefore, there will not be any difficulty if you wish to withdraw your case. Even if you do not want to withdraw your case, you may complete the proceedings in the case i.e. file your complaint, evidence by way of affidavit and thereafter you can file written arguments stating your stand and request the forum to decide the case based in written submissions and waive off your right to argue the matter orally. Thereafter the matter will be decided by the forum without your presence and the order of the case can be scrutinized by you online or by calling up the forum.
