Dear client,
1. All candidates including yourself give a police complaint against the consultancy.
2. Submit all proof of documents, receipt etc with the complaint.
3. The above said matters will come under the criminal complaint.
4. Other option is file a civil suit for recovery of money.

Hi,

Yes, this is a fit case to be proceeded under Consumer Protection Act as it is clearly deficiency of Service as the assured service was not provided. But, it is highly advisable to proceed with a criminal complaint against the Consultancy for cheating under the Indian Penal Code.

Firstly on what basis have you paid the lumpsum to the consultancy? Have you signed any contract? If so gather the documents or your conversation with the consultant and lodge a police complaint (without proper proof no complaint would be taken up). If possible kindly coordinate with the other candidates placed on your footing and file a joint complaint. If the complaint is not taken up you could approach the court seeking for a direction on cheating. Secondly if you possess ample proof to submit your claim or wt ever you have pooled onto the consultancy then you could seek for compensation before the appropriate consumer forum.

Caveat emptor, You had failed to disclose the documents you have, and you have narrated only the incident. So let us tell the documents on which you rely. If you are able to establish that his motive is to cheat then he is liable to prosecuted for cheating, and liable for civil damages also.
