Hire a cab driver drove rashly inspite of warning met with an accident

My fater-in-law (72 yrs) and mother-in-law (68 yrs) were travelling in a cab from Shilparamam (Madhapur, Hitech City) towards Bowenpally (their place of residence). The cab driver drove rashly. Inspite of their repeated requests, he drove fast. Upon crossing Balanagar Police Station, he crashed the cab against the road divider. FIL: shoulder bone fracture, deep cut on his leg, some bruises. MIL: left wrist fracture, head injury, some bruises. The owner arrived late to the hospital and we paid from our own insurance. Can we file a case for any medical/immobility claims which already paid?

In case of a motor vehicle Accident the Insurance Company of vehicle by which accident took place pays the Compensation to the victim provided the vehicle had a valid insurance policy on the date of the accident and the driver of the vehicle had a valid driving licence. If the vehicle or the driver does not have a valid license then the owner of the vehicle and the driver jointly pays the compensation.
