Harassed by company regarding payment issues what legal options there?

23-Jan-2023 (In Consumer Court Law)

I did not get proper service from MTS and followed up approximately 30 times with MTS CC and escalation team and store visit. Issue was not resolved and they kept sending bills to make payments. I stopped payment and got the service disconnected. I received one email stating its a legal notice from MTS and post discussing with the stated lawyer I agreed to pay 70% of the outstanding as delegated rep of lawyer offered to get the remaining 30% waived off. Wasn't waived off and I am still receiving reminders for those 30%. What are my legal options? I have all emails and message with the offer

If you have any document from MTS regarding waiver of the balance 30% , then they become bound by the principle of estoppel . You really dont need to do anything except issue them your waiver document along with a representation, briefly communicating their wrong doings.

A very good day to you!!
Firstly, the information you have provided is insufficient to provide you with an appropriate course of action right away. If you could satisfy the following queries I will be in a better position to advise you:
1) Whether he was the true and legitimate delegated representative of the lawyer? And how can you be sure of this?
2) When the lawyer agreed to settle the payment amount with you, was anyone from MTS marked in these discussion? Were they aware of this settlement between you and the lawyer or was MTS a silent spectator? Proof of the same maybe required.
3) When was the connection taken and when was it disconnected?
Secondly, I would like to state that a lawyer does not have the right to settle a matter with a customer without the Company’s express consent and approval so in the absence of such consent, MTS’s claims for the 30% amount maybe justified. However, since you had been been harassed by the Company due to irregular and dis-satisfactory services and you have proof that you had approached MTS on several occasions to get their services rectified and problems resolved failing which you discontinued services, a legal notice can sent to them stating that they are indulging in false advertising and misrepresentations regarding their services' quality & customer satisfaction, and that you are not liable to pay outstanding dues much less the 70% amount you have already paid to them. I hope this clarifies your doubts and helps you decide a way forward. Looking forward to hearing from you.

You here have a very strong case of deficiency in services and unfair trade practices. We can file a recovery suit and also a consumer complaint. Also the amount paid by you alongwith interest and compensation can also be released.
