Forcefully selling two wheeler parking after possession

29-Dec-2023 (In Consumer Court Law)
My builder has done a lot of illegal things. He has recently issued notice to buy 2wheeler parking and stopping/harassing residents forcefully to buy 2wheeler parking. We have met development authority, SSP, CO, SHO and DM but nothing is coming out. There is no other society in the area where 2wheeler paid parking is being charged. Builder has never informed us about 2wheeler paid parking at the time of flat purchase. Now after 1.5yrs after offering possession and many buyers have done registries also. His employees initially confirmed verbally that residents can park 2wheeler in open area below tower or in their car parking along with car(if it accommodates) as it is being done in other societies. At the time of possession builder given a society guideline booklet where he mentioned that if 2wheeler can be accommodated along with car a resident can park it. but now he is not agreeing to any point. he has already stopped 3 times and it was opened with Police intervention. Plz suggest

Hi, send a legal notice to the builder through your lawyer and you can mention the clause of the contract where he says the 2 wheeler can be accommodated with car parking. In case of failure you can approach consumer court and file a case against the builder.

Hello in your question you say in your builder don't give free parking and he change for parking , so I tell you if in aggrement builder not disclose any point for charge about parking and not his society guideline booklet so he don't take any advantage so you file a case in civil court in Indian Easement act 1882 .....

Dear Sir,

This seems to be a fit case of malpractice. If you are the owner of the flat/apartment then you have the right to approach the Court (Consumer Forum) and seek redressal. However it is advisable that you initially send a legal notice seeking your grievance. Meeting various authorities will not help.
