Flat booking cancellation and refund of application money

Sir, booked flat with Bangalore builder and send application money of Rs. 2 Lacs plus Rs. 4.37 Lacs before entering into any agreement. Visited Bangalore in April 2016 for entering to agreement. Since the builder asked for more money, didnot entered into any agreement and asked for refund of entire amount. The builder is asking for self signed letter for 20% deduction of the paid amount, since there was a clause which stated forfiet of 20% of the bking amt in case of cancellation. I proposed for atleast 10% of deduction of booking amount not on the subsequent paymnt. The builder is not agreed

20% is huge, you should have read the clauses before signing the agreement. Try to negotiate with him and see if he reduces it to 10%, else, take the 80% of the money and then you can give a police compliant and try to get an FIR registered against him. Dont get into a quarrel mode until you receive the 80% of the money.

It is an absolute cheating from the builder, you act in accordance with the agreement. Have you got any document regarding payment of money in instalments.
Issue legal notice to refund the money, if builder denies then file a suit for recovery of money.
