Emi for building not paid, can bank take action against me

Any legal action can be taken against builder associated bank as and may I stop paying my home loan Emi as the builder is not constructing form past 1.5 years. As I see the bank is the contractual party between me -builder who did agreement for both of us, as now builder is the defaulter. - /

Hello,
For the query you posted, I would suggest the following:

You can always approached the concerned consumer court and get a relief to that effect.
There are precedents set in that case and it would be very easy to get relief.

File a complain in the NCDRC if the amount is one core or more. Make bank and builder party and contest. Seek a prayer for status quo of emi payment. Ask for refund of amount with interest, this can solve your problem. You can also pray for an alternate property with extra square feet

Hi, surely cause of action has arisen against the builder who has defaulted in completing construction. You may ask for special and exemplary damages for it. You are suggested not to stop EMIs of bank loan, else you will become defaulter for the bank. You may recover the amount from builder. Further, you are suggested to inform the bank in writing about these sufferings.
