Does GST apply in a car lease made before GST was implimented
04-Jul-2023 (In Consumer Court Law)
I am on a 4 year company car lease since June 15. In April 17 when I had asked about options to exit the lease I was given 2 options in writing and associated quotes - 1. Give the car back to the leasing company & pay surrender value of Rs. 290000 2. Buy the car from the leasing company at Rs. 790000 I decided not to pursue either option & continue the lease as it is. In June, we heard from the company that monthly EMIs would be significantly going up from July due to GST & we again had the above options if we didn't want to continue the lease. This time when I asked the leasing company the value to the buy the car they came back with Rs. 11,400,000 which is 3.5 lacs more than what they quoted in April when car was newer and had driven lesser. Are the leasing company bound to honour the offer they made in writing in April (it says valid till end of contract) or they can can change it now? My company is not intervening and offering much support here. Can I go to consumer court here?
Company is bound by the terms of the agreement. They cannot change it as per their whims and fancies. There has to be a provision to change the same and in such an event they can do so but without looking into the terms we cannot suggest you anything in clear terms. However, you have every right to move the consumer court for deficiency of services and you will get a result depending upon the merits of your case.
First thing is that you should find out from the lease agreement you signed with them and see what kind of exit was n it. Next is to decide what to do. As of now you don`t have a cause of action to approach any court, as they have not done anything yet.
