Does district consumer forum case dismissed by itself

29-Jun-2023 (In Consumer Court Law)
I filed a case in the district consumer forum which was on reply stage. I went to court on every single hearing and everytime they used to say come on next date. Due to some personal issues i missed my recent last date and my case was dismissed right away on that day itself. I mean when they can give so much time to the respondant's advocate, why cannot they just issue notice to the petitioner and wait for his excuse atleast ? How should i proceed further now ? Is apealing in the state forum is the only option or there is some better and easier option as well ? And what if i drop the case here itself and don't take any further actions, can the respondents put on a case on me ?

Yes, you have an another option too. For this you can move an application before the same District Consumer Forum for restoration of your complaint, mentioning the reasons for your incompetency to appear before the forum on the date of hearing.

You have to file an appeal with the State Commission within 30 days of the receipt of the order of District Forum. There is no other way since the District Forum does not have the powers of review. If you do not do anything nothing is likely to happen. The company cannot do anything unless they want to file a case of defamation which is not likely.
