Delay in providing documents by the builder now claiming interest

I had purchased a property in Noida Extension. I had already paid 50 % of the property cost and rest is to be paid by the ICICI Bank. In December 2015 I received a demand letter from the builder for rest payment. I forwarded the demand to ICICI and its executive approach the builder to get some documents but builder denied citing delay from G.Noida Authority. Builder recd. reqd. documents frm authority in April and demand was settled accordingly. Now builder is asking interest from Dec to March saying that initially demand was raised in Dec. but delay was from build side

In one the Judgment the Hon'ble apex Court has held that if the delay is by the builder then the builder is not entitled for the interest upon delayed payments. Therefore you are not required to pay the interest upon delayed payments.

It is a case of deficient services, you will be required to serve the builders with a legal notice, however prior to which it is recommended that you file an RTI, inquiring from the concerned authorities whether the project has received necessary sanctions and substantiate the same in your notice and claim accordingly.
Secondly has your loan been sanctioned if so then has the bank refused to honour the demand letter. It is required to share the details to help me guide you accordingly.
