Delay in possession of flat what can i do.

, I booked a flat in Noida Extension in 2012. Builder was supposed to deliver my flat in Dec 2015 but still it is far away from completion. I asked the builder to return my money and let me surrender my flat since I am not able to pay rent and emi together. But the builder is not allowing me to surrender my flat.
you may approach the consumer forum claiming the compensation for the delay in delivery of possession and also if you are suffering rent due delay in possession you may claim the monthly rent on actuals. however appropriate opinion may be given after seeing the documents relating the agreement.
You are entitled to get back the amount paid by you. You may file a case in the consumer Forum for the same. I regularly deal in such matters, you may contact me for further assistance.

You can file a case before the consumer forum, subject to jurisdiction. Yes , you can get your total paid amount alongwith interest, if there is genuine delay in handing over the flat in question. But there must be specific mention of each and every things in the moa or valid contract between u nd the builder in question. Hi... please be advised that as per the supreme court, if the developer having received the payment, does not deliver possession of the allotted plot/flat/house within the time stipulated or within a reasonable time, or where the allotment is cancelled or possession is refused without any justifiable cause, then you are entitled to refund of the amount paid, with reasonable interest thereon from the date of payment to date of refund. In addition, you may also be entitled to compensation, depending on the facts of your case.
