Deficiency in service can extortion be filed have proofs

If A sends legal notice to B regarding deficiency in service under consumer protection act and B in return sends a reply cum notice stating all the allegations are wrong and directs A to withdraw all the allegations. Now A sends a reply to B stating that the allegations are valid and with evidences then can B file a case against A for extortion or any other thing ?? Please suggest

B can file but it has no merits. This is the definition of Extortion under S. 383 of IPC: "Whoever intentionally puts any person in fear of any injury to that person, or to any other, and thereby dishon­estly induces the person so put in fear to deliver to any person any property or valuable security, or anything signed or sealed which may be converted into a valuable security, commits “extor­tion”.
What A is merely doing is bringing the evidences before B. Now in case these evidences are fabricated and A is "dishonestly" trying to get something (including money, property or any valuable asset), then it may amount to a case of Extortion. But as long as those evidences are true and correct, the motive is to seek compensation for deficiency in service, then A should not be worried of any Extortion case.

Both are at liberty to file any case. But you don't have to play ping pong with notices where both parties keep alleging or denying. Once the notice and reply is done with. the option is with either party to approach court. Demanding a legal right by a consumer cannot be easily categorised as Extortion.

When there are allegations and counter allegations in any matter, the proper solution can be obtained through legal remedies such as mediation, arbitration or filing of case in court of law. You may take appropriate step according to situations.
