Deficiency in service by travel agency what action can we take

I had booked air tickets for my guests through a Delhi based travel agency against advance cash transfer to this agency's bank account. Once guests reached Bangkok, their return tickets were, without any reason or advance information, cancelled unilaterally by this agency and refund pocketed, as confirmed by airlines. Where can I file consumer case and how?

The case can be filed in Delhi where the office of the travel agency is located and also the money was paid in Delhi. The case can also be filed at the place where the consumers are located however then a leave of the court has to be obtained otherwise it opens up a door for the other party to raised an unnecessary objection regarding the jurisdiction of the court. If a case has to be filed then a complaint can be made directly to the Forum where the defendant resides and has its place of business. In these cases however the court may try to amicably resolve the dispute by mediation and if it cannot be done then the case is proceeded with.

Your case will lie in new Delhi. Depending on the amount you may file case either in District forum or state commission. For that approach a counsel who is able in such matters. Also I will advice sending a legal notice before this

You can file a consumer complaint for deficiency of services by the travel agency before Delhi State Consumer Commission which entertains complaints where relief claimed is upto Rupees 20 Lakhs. Good luck

Depending on the quantum of loss involved you can approach the district consumer forum ( upto 20 lakhs) or state consumer commission. Please add the damages amount as well.

In case of deficiency of service by any service provider including a travel agency, you can approach the relevant consumer forum for refund, damages and compensation..

In case your claim is up to Rs 20 Lakhs, you can approach the relevant district forum, if in case your claim is between 20 lakhs to 1 crores, you can approach the state commission and if the claim is above Rs 1 crores, you can directly approach the national commission.

Further, in case a lot of consumers were affected through one action and many or all of them want to take action against the travel agency, then all such consumers could consider filing one class action against the travel agency.

As regards how to file the consumer complaint, the same could be filed at the relevant forum either by you in person or through an advocate.
