Company hiding few fact while selling old model can I file case

02-Apr-2023 (In Consumer Court Law)

I booked a Maruti Swift Vxi on 20 Oct 15 through Popular Automobiles, Chennai. The vehicle was delivered to me on 07 Jan 16. However Temp Regn papers were not handed over to me at the time of delivery and later on it was forwarded through courier. At the time of perm Regn it was revealed that the vehicle delivered was of 2015 model. I feel this amounts to unethical/unfair trade practices and the company has willfully concealed the fact and cheated me. can I approach Consumer Forum for compensation.

You first check the date of delivery mentioned in the delivery chalan to that of the invoice for the car.
Whatever the circumstances, the date of delivery from the showroom shall be counted for the model o the car and not as per the convenience of the dealer.
If the dealer is not accepting to change the year of model, you may first issue a legal notice to him giving the complete details namely booking, payment made, invoice date, delivery challan date, date of actual delivery as per the outpass/gate pass from the showroom, date of receipt of temp registration from Show room etc., demand the desired changes to be made immediately with a copy endorsed to the Maruti company, if you dont get a reply or proper response, you may drag the dealer to the consumer forum seeking justice and compensation for the physical and mental loss of energy
