Company did not deliver product as promised what can be done

asking for refund amount given for purchesing scooter with side car. as I have paid full amount to automotive while booking, as they are not fulfilling promise given by them, they promise me for returning money but given cheques are getting bounced..what can I do.? How can i fileCOmpany did complaint.in consumer court and by which law I should submit the complaint.

In your case you can file 3 types of complaint against company.
1. You can file compliant of dishoner of cheque u/s 138 Negotiable instrument Act & claim Recovery in court of JMFC & criminal action will be taken by court.
2. You can file compliant in Consumer Court under groudns of Cheating & calim all recovery.
3. You can file another seperate criminal compliant of cheating by company then criminal action will be taken by court.

You can issue notice to the Automotive Company for delivering the possession of the scooter within 7 days failing which you can file a consumer complaint for deficiency in service and unfair trade practises claiming the price of the scooter paid by you and in addition to that damages for mental harassment and agony along with cost of the Litigation. You can also file a winding up petition under the Companies Act 1956.
