Can I sue the society for refund of the amounts paid by me

10-Feb-2023 (In Consumer Court Law)
I bought a 1000 sft office in a building under construction in 2011. In 2012 the builder handed over the office for interiors and fittings but with clear instructions not to occupy the office till BMC issued OC. There is no OC yet. In 2014 Some owners started occupying their offices. They have been charging non occupiers for all expenses including water electricity security etc. As the building does not have OC the BMC has started levying property tax at penal rates on those owners who are occupying the offices, but not on non users. The users formed a cooperative society which was registered in March 2016. Non users have not been made members. The society has threatened others not let them enter the premises till they pay for maintenance bills starting from 2014. Under duress I recently paid the arrearswith 21% interest as I wish to use the premises. Now that I am in possession of my office, Can I sue the society for refund of the amounts paid by me under duress.

Indeed we can file a recovery suit with atleast 18% interest along with legal fees(advocate and court fee)...From the accused builder and maybe from BMC as well. Do find my email on ur I'd and revert on it while you do so.
