Can a consumer court change its own judgement

State Consumer Commission (SCC) has ruled in our favor ordering builder to give us possession of Plot X. SCC rejected plea of builder of their inability to give plot X as it is under civil litigation. Builder's appeal in NCDRC was rejected with fine 50K. We filed EA (Clause 25) in SCC and & is under hearing. Can SCC change its earlier judgment & consider new evidence from builder that he can’t give that particular plot X? We requested SCC for same plot X or money back with suitable CI but builder is offering 9% SI. Also builder has filed SLP. What are the options available to us?

Hi, you have file EA in SCC and in this case the evidence on the part of builder will not be recorded or heard. one the matter is decided by ncdrc the scc is bound to act on your application. however, if the builder comes with stay in SLP, then the process may be delayed till disposal of SLP.
