Builder violating construction rule & not giving occupancy certificate

Plot given to a builder for development through registered agreement which has mentioned to be constructed as per the guidelines of Local Bodies including Municipality to ensure legality and also to avail Occupation Certificate too. Permission was for four floors but he violated and constructed three more floors so No Occupancy certificate from Municipality. Builder has given only 25percent from agreed 50 percent share to us and has sold rest of the flats. Now he is just committing since two years now to give us the balance of our share in his another project. But we think he is just time passing and not willing to give us the balance share. We are unable to sell the flat which we have received from him due to unavailability of the occupation certificate. Some who are willing to purchase without OC are offering very very less price. Now my question is >>>> how and what actions can be initiated against him, criminal, consumer or civil?

From above submission it seems that you are a seller of plot but in lieu of the cost of plot u recd a flat in the scheme of builder. Hence become consumer of builder. U can file case before Consumer forum or commission
