Builder not returning booking amount what are my legal rights

Hi I have a flat at Jaypee sports city. They are not in a mmod to deliver and even after 6 years are offering only base amount refund that too after 8 - 9 months.I have paid bank interest for long and pls advise how can claim compensation

indeed you can file a consumer complaint to the consumer forum depending upon at amount paid and the interest paid to the bank. however, it is imp to see that from the date of cause of action, the consumer complaint has to be filed with 2 years period.

You can file a consumer complaint against him in the Appropriate Forum for delay in delivery in possession and deficiency in service.
It is advised that you send him a legal notice demanding refund of money along with interest. In case he fails to pay within a month, file a consumer complaint under the Consumer Protection Act.

You may choose to file a consumer complaint against the builder before State Commission or National Commission (depending upon territorial and pecuniary jurisdiction
) and claim refund with interest rate.
Commission has been passing orders in favour of consumer in such kind of cases.
