Builder not providing satisfactory and safe society roads

Hi Sir/Ma'am, I have purchased a flat in palwal Omaxe city.This is complete city developed by Omaxe.They are asking to take the flat possession as they say the construction work is complete.But the road which they have developed is one and only single road to reach the flat is in very bad condition like no one even can walk and reach to flat.Heavy construction work is going on the road itself for some school construction.For the construction heavy trucks comes on the road daily, may caused some accident.But still Omaxe is saying that either I have to take possession or pay penalty,maintainace

You must immediately write to the builder telling them all these problems and tell them categorically that you will not take over the house until all the internal roads and other development works are completed. Do keep a proof of dispatch of your letters. Keep their reply also in file in case they give a reply. If they impose any kind of maintenance charges then you can approach the consumer court.

With cases like this my advice to you is that you please check what the builders buyer agreement has to say and based on the contract you can proceed to consumer court.

Hi,
Your problem is not with your builder, and it is not the responsibility of builder to make the public roads unless any clause mentioned in the agreement with the builder ( Omaxe ), so you can talk to the Municipal authority to solve the problem besides this you all the society member can make a request for this problem to Omaxe and ask them to help out in solving this problem.

If the you are not satisfied by the work done by the builder and if it is not in conformity with the claims made by them when selling you and put down in the prospectus then you could approach the Consumer Court making out a case of deficiency of service against the builder asking for direction to mend the road and even claim compensation from the builder.
