Builder not providing possession

Respected Sir/Mam, I booked a flat in Noida,U.P. in 2011 and was promised that it will be given to me by 2014. However, till date construction has not been completed. I am looking to get a refund considering that construction is going on at a very sluggish rate but builder is never available for the meeting. Kindly advice how can I proceed. My religion is hindu.

It is suggested that a written letter is sent to the builder from your side. Thereafter, if he still does not respond we can contemplate sending a legal notice through your Advocate. Depending on his response we can proceed filing case in the consumer court. Also, your religion has nothing to do with this.

Well you may proceed under the Consumer Protection Act. law has already been established for the protection of consumers with the passing of Real Estate bill but the authorities are still to be established. Right now You may proceed in the appropriate forum depending upon the amount you claim.

Kindly go through the Agreement and confirm month of the year of possession. you can file complaint to the consumer court as per jurisdiction according to the cost of the flat and you can demand whole money from the builder with interest and you can also claim the litigation cost and compensation for mental harassment due to delay in possession of the flat.
