Builder not paying refund of my booked flat how to proceed legally
19-Feb-2023 (In Consumer Court Law)
I purchased fault 5 years back, but Builder had delayed the project I want refund of my paid money 90 ℅ of total value with interest & penalities. Kind advise me. Thanks Sanjay kumar 9212377409
U have to file case for recovery or possession. Vise versa it's depends on you which remedy u want to avail n law. File a case in that way and press for recovery of amount and possession what u wanted

you have not mentioned the time duration for completion of project in builder buyer agreement if the time period is exceed as per the agreement you can file a complaint in consumer court and demanding your paid money with bank interest with compensation and cost of legal proceedings

if you have paid booking amount to the builder 5 years back then limitation for filing consumer complaint expired however, the terms and conditions of the allotment would be the deciding factor. in case you have made the last payment in preceeding two years you may file a consumer complaint.
