Builder is not willing to pay the amount order by the Court

We bought a house from builder Arun Shelter Bangalore in 2014 with a down payment of 11 lakes.They changed the entire project just after 5 month of launch and didn't get appprovsl for the same so stayed the construction. So we tried to withdraw from it and asked them to return our money but they refused saying they don't have money to return. We filed a case in consumer court and civil court : civil court has launched a warrant against the builder and in consumer court last month after one year gave the decision to return the amount with interest in 15days. The builder approached us asking us to sign a paper in which we agree to get the principal amount without any interest but we answered them saying please follow the orders or court. We are not in India right now and so don't know what to do. If builder can take the advantage of the situation? We appeared in all the hearings of court for 1 and half year but nothing happened. Now we don't know how to proceed.

When order has passed in your favor then what is the worry. Take it to the jurisdictional police station and call the parties there and tell them to comply the order. Or move the I.A. with Affidavit before the said Consumer Forum and request to provide the police protection to enforce the order as the respondent has failed to obey the court order.

Immediately file execution petition before consumer court to execute and get attachment of their property as earliest. You can only approved through court cantact me with all the details to guide properly

you seem to have obtained an award from the Consumer Forum. In case the builder has not complied with the award, you may take out execution proceedings for recovery of the amount as per the award. You apply for execution of the award. Take the assistance of an advocate who can do the needful in your case. Since you are not in India, you can give power of attorney to a trustworthy and reliable person in India to follow up the proceedings and to receive the recovered amount by way of DD or cheque so that the same may be deposited into your Bank account, to save yourself from any chance of your money being misused.
