Builder is not giving receipt and not depositing cheque what can we do

We have entered into sale agreement with builder for purchase of a flat in mumbai after paying our contribution. We tehn applied for loan and bank disbursed around 80% of the loan amount as first installment and directed us to pap the diff amount of Rs. 75K to builder for releasing the second installment. Now Builder is not giving us the receipts and not depositing the cheques. We know he is doing it purposly as he want us to pay service tax and VAT which we are not liable as this one is ready to move flat.
