Builder delayed possession can i file a case against him
20-Jul-2023 (In Consumer Court Law)
We purchased a flat(sale deed registered) IN August 2013. Builder promised to finish construction in December 2013 but still he didn't finished. We want to file consumer case. Question is whether it court will admit my case and since 2 years duration is already over, should i provide valid reason for delay?
Dear Sir/Madam, you have every right to get delayed compensation from the said builder. With regard to cause of action, the cause of action arose when they failed to comply your demand for the same, you have continuous touch with him in this regard, therefore the cause of action will continued as on today, you don't worry about this, I would like to advice, you have to immediately issue a legal notice to the said builder for the same, if he failed to to do the same, you have to file petition before the jurisdictional consumer forum. You can file a complaint against the builder provided you have to issue a legal notice to your builder asking him for such a long delay incompletion of work and in that notice you have to demand loss of monthly income( by way of rent if the flat is given to any third party for the duration) and other damages by giving specific time to complte the work and also to pay the damages, in case if the builder fails to comply your notice, you can file a complaint and no limitation will attract.
