Builder changed location and size of the property without telling us

Hi.
Well it depends which state!
In Maharashtra, They can't unilaterally change adn demand extra money
You may challenge the same under Civil laws of india.

You must first check the buyer's agreement signed with the builder and see what the terms and conditions are with respect to the change in location and size of the property you have bought. in case it allows the builder to change the same then you could simply try and negotiate. If there is nothing in respect of it then you could take them to the Consumer Court. Also, in case the agreement allows the builder to change the location and size you could still take them to the consumer Court and still try although the clause may weaken your case to a certain extent.

Kindly check the terms and conditions of the Builder Agreement. In case there is a provision of change in location of the shop then it can be done but certainly it cannot be done without your consent and moreover, the size of the shop cannot be changed at all. This amounts to unfair trade practice and deficiency in service which can be challenged before the Consumer Court. However, do remember to plead that you have purchased the shop for your livelihood else you would not fall under the defination of consumer as the property is a commercial property.
