Builder asking for separate parking charges can I file a case

Dear Sir, With reference to the parking fees charged by the builder. I bought a flat at BG road Bangalore paid Rs 2,00,000/- + Rs 1,113,600/- preferecial charges. Earlier agreed to allocate the parking on ground floor but not provided on 2nd level basement. Builder has shown a separate parking charges and preference charges on his price list provided. A case can be filed for the refund ?

Dear Sir, Yes. you can filed petition before the District Consumer Forum Bangalore for rendering service of deficiency by the builder to you to claim for refund the amount as well as claim the compensation for mental agony and deficiency of service... if you want my legal service I will do it.

You can first issue a notice to the builder for collecting exorbitant amount towards car parking fees. and thereafter you can file a consumer complaint against the builder for deficiency of service before the district forum.

Certainly it amounts to deficiency in service, which consumer disputes. When builder is agreed to provideallocate the parking on ground floor it is his bounded duty to provide as agreed, first give a notice claiming compensation for violation of breach of agreement and refund of money .
