Bought phone online and not providing warranty for the phone

Hi, I bought a phone(OnePlus 2) online from ebay, for which they have mentioned a 6 months manufacturer warranty. But when i contact the service centre they clearly told me that if you buy this phone apart from flipkart, amazon or snapdeal there will not be any warranty. I have proof from service centre. I tried to contact ebay customer care and as usual they have created a service request. It's been more than 15 days since that service. i have tried many times to contact ebay customer care but there is always a continuation of the service request. What should i do in this case?

Issue a legal notice to ebay and infomr them that you need a replacement fo the mobile as you are having 6 months warranty. Unless your warranty purchased from e bay says there is no warranty you will not have a case, otherwise issue legal notice and follow with consumer case for deficiency of services, compensation and mental agony.
