Booking amount giving for car purchase but owner sold it already

I Booked a car from dealer and also given a booking amount to him for confirmation he given me a receipt for booking amount. He said once loan amount will be sanction I will give you the car now I got the approval for a loan, but the dealer sold the car to someone else. and i also have voice recording .Sir kindly help me with this

Once the booking amount is paid for purchase of car and the same is not sold to you by the dealer even after loan was sanctioned then in that case it be better if you file a suit for specific performance for sale of car against that dealer.

Yes you may file a case in consumer forum for deficiency in service .with you may ask for compensation with cost of litigation. You may also file a case of cheating under criminal relief for conviction as remedy . it purely depends on wish which remedy u opt for

This question is not providing the entire fact, in case in receipt the terms have been mentioned you may file suit for specific performance as per the terms available with you. Here, it requires the terms on receipt so that you may get the model no. of vehicle, manufacturing company of vehicle etc.
