Agency not delivering project post taking advance forcing to pay

I had hired a development agency from Gurgaon on Freelancer.com to build a website. Have already paid 50% fees and they delayed the project. Freelancer.com arbitration team ruled in my favor and said they did not complete the project and closed it. Everything is on the agency server and they refuse to release it till I pay balance 50% and then they will finish remaining work. I cant trust them as they had said they will finish project in 7-8 days and it is 8 months now. What if I pay and they don't finish. How should I proceed?
Initially, get everything in writing, the terms and conditions of work,mode of payment and the duration of completion of work with them so that if they fail to comply the terms, you can file a complaint against them. If they are insisting on the payment first, you can very well give them a conditional post dated cheque and get the work done.
