Accident caused to car by showroom driver during pick and drop

I stay in Mouda near Nagpur. I own a maruti zen car. I gave it for servicing to a maruti Suzuki showroom near my place. I availed pick and drop facility provided by the showroom. after servicing when the driver was returning, he met an accident and caused some huge damage to the car. He was not seriously injured. I was called at the location. I had a third party insurance as the vehicle is second hand. I had some discussions with the showroom management. They said that approximate estimate for car repair is 94000/-. We asked them to pay 90% for the repair as there is no fault of mine for this accident. They said they will be sharing 50% of the cost. They also have a slip which I signed during pick up of the car. The slip has the declaration that says Customer is responsible for any damage caused during pick and drop. Please tell me what to do for this case.

Dear Sir/Madam,
If the company is not ready to pay the amount for the repairs, send them a legal notice directing them to carry out the repairs or in the alternative pay the total cost of the repairs. If the company does not respond you can file a consumer complaint before the district forum, seeking order against the company for payment of the repairs of the car and also seek damages from them for the trauma and the mental agony caused to you.
