Where should the case be filed in case of business being in Kolkata

15-Apr-2023 (In Civil Law)
My business is in Kolkata, where I also reside. I supplied materials worth approx Rs.30,000 to another company in Bangalore in Jan 2016. Approx Rs.5,000 is due and they are not paying up despite many reminders. If I file a case against them, can it be at Kolkata? Can the defendant ask for the case to be transferred to Bangalore?

No they cannot transfer the case. File a case in consumer forum. They must have given you a cheque of 30,000/-
Which is the norms these days as you were to provide them raw materials of that amount. If you have taken such a cheque that draw it in your account and if the cheque bounce file a cheque bounce case under N.I.Act too. See Mr. 5,000/- is a megre amount that's what they are thinking and that's why they are not paying you. But I can assure you that you will get a lot more if the matter is taken up in consumer forum. We can come into agreement me, you and my firm which is situated near high Court if you have water tight evidence to prove the same. Do contact me through LawRato and we will see to it that you have the last laugh. N limitation period of 2 years is applicable in consumer cases so hurry up.

Yes, you can file a case in kolkata as the cause of action of your case is in kolkata and it is to mention you that the defendant cannot transfer the case to his jurisdiction as the cause of action of this matter is in kolkata.
