Section 3 of the principal Act has been amended as under,—
(a) sub-section (2) shall be omitted;
(b) sub-section (3) shall be renumbered as sub-section (2) thereof;
(c) after sub-section (2) as so renumbered, the following sub-section shall be
inserted, namely:—
"(3) Whoever enters into any benami transaction on and after the date of
commencement of the Benami Transactions (Prohibition) Amendment Act, 2016,
shall, notwithstanding anything contained in sub-section (2), be punishable in
accordance with the provisions contained in Chapter VII.";

See sub section 3 there is mentioned " on and after of Commencement"

It is for your kind information that law is always applicable from the date of enforcement not before that, any matter pending before the amendment only the previous act shall be applicable since there is no retrospective effect of the law and judgement same was reiterated by Supreme Court in Vodafone case.
