What happens to the recovered amount if an EP has been closed

What happens to the recoverd amount if an EP has been closed ..as the decree holder company has closed the ep in 2008 and the amount was fully recovered after eight years now in 2017 the company again filed a fresh suit stating that no amount has been credited in the court in that respective EP . Please let us know how to proceed to trace the previously recoverd amount

All courts will have court records such as case diary of all court proceedings for atleast 12 years.
So please apply for copy of court records such as case diary, case records etc in the court where Execution petition was filed.

You must agitate in the present suit by filing your answer stating that the amount was already recovered in the E.P. which was filed against you and salary was attached and the D.Hr. received that amount and E.P. amount was recovered by placing documentary proof of salary deduction from your pay disbursement officer. If previous E.P. number and O.S. number were remembered by you, you may apply for certified copies of the same and file the same in the present suit along with your answer. The entire record may be available in the concerned District Court. Thoroughly investigate into matter and file the documents with your answer in the present suit get the suit dismissed.
