01-Dec-2023 (In Civil Law)
a hindu person has married 2nd time as first wife is expired but have one son and a daughter from his first wife and again he married with second 2nd wife but no child was born from 2nd wife and he adopted a abandoned female child from some where and gave his own name as father in school both kept her in their home as daughter for 13 years(minor) and father gave a piece of land to her by way of gift deed in the court where he has written that she is her real daughter again his 2nd wife expired and with the pressure of his children from first marriage they throw out the girl from there house but before death of his 2nd wife she also made will and give all her property to the girl and will is also probated in the court but now he refused in the court that she is his daughter but in court she is getting some money as expenses for her now his father doesnot want to give her any property please guide us can this person refuse his gift deed in the court when she will be18 yrs after a month
No once the gift is given and is accepted by other party ie Donee it can't be taken back and the gifted property is the absolute property of the donee without any hindrance from the other party. And when the will is also probated by the consent of father it is the absolute property of the person on whose favour the will is probated. It cannot be challenge there after. She can also calim her share from her father property. Whereas the matter is little bit twisted some more advice can be given after some personal discussion and queries.
Thnx and have a good day
