Spouse took loan can lender force me to return the loan

21-Nov-2023 (In Civil Law)
My spouse took a loan from a friend on stamp paper without specific timelines for return. Can the lender impose timelines based on his discretion. Can the lender force the husband to pay threatening legal consequences on the husband. Can the husband take action for such behaviour.

Hello ,

Time limit not mentioned in the promissory note is immaterial - the lender will make it well to suit his convenience. The lender can inform the husband to pay the dues of his wife telling the legal consequence befalling his wife in the event if the wife doesn't concern about defaulted payment. If lender misbehaves police complaint can be lodged. But the police will definitely ask your husband to summon you for inquiry. Legally speaking the lender can file MONEY Suit in the Civil court for recovery and he cnnot make husband to pay the borrowed amount.
