Siblings cheated and took property, please advise

Our land is not divided in equal in 4 brothers and 2 daughters they cheated my father but as son I filed case in civil court for my dad portion then civil court ordered 1/4 share for me & 2doughters exparty in the case.after 321 days RA WAS preferred but due to delay it's dismissed in the court now I filed caveat in high court Shall they go for high court for the stay and dismiss of the 1/4 th share

Your right cannot be denied if it is inherited by you as per law. Yes they can go to high court, as you have filed Caveat you will be informed and heard when the case will be posted before the court. So nothing to worry.

The chances of success is very low. But it all depends upon the advocate they engage. You must avail legal services is Senior Advocate to see that their R.A. should not be admitted on the ground of delay. Hope you will get justice.

If already partition made by your father and for the remaining share of your Father filed Case and the same decided on merits by Civil Court of 1|4th share and same dismissed on merits and appeal dismissed on ground of Limitation

If appeal filed against the same to high court again there is chance of dismissal but high court is having discretionary Power can interfere also if found and convinced merits on it

Hi. If they are interested to prepare an RSA before the High Court, they will file,but they will not obtain stay because you have filed caveat. Court has to issue notice and has to give an opportunity to you before granting stay.

You can directly approach revenue authorities to get the lands mutated in your name. RTC to be obtained and land taxes to be paid regularly. And hold the possession and enjoy the properties. Wait and see and renew the caveat after 90 days.
