Applied for LT load (Low Tention) of 129HP at the time of applying for license .According to Regulation 10.1 (2) (i) of the JERC (Electricity Supply Code) Regulations, 2010 and guidelines provided under Regulations 10.3(b)(i) of the JERC (Electricity Supply Code) Regulations, 2010 industry is liable to be proceeded under Section 126 of Electricity Act, 2003, for unauthorized use of electricity. It is the case of appellant industry that additional machinery were connected in excess of the sanctioned load, In this case the Industry was levied a fine of 49Lakhs so is there any chance in this case where the industry could come out of it or ask for a lower amount of fine taking into consideration that: the bills were paid timely, the extra load was just a standby load, the sanctioned load was never exceeded in operation. Please let us know what to do.
