share from ancestral property

we are one brother and 2 sisters. my father had 40 acrs. my father and brother wrote partition agreement in 1990 without our concern. father wrote 32 acrs to my brother (9 acrs) and brother family (23 acrs) at 1990. my brother died 2007. my father didn't give anything to us. can we claim for share in 40 acrs ancestral property.

You can claim share of the property. File a civil suit at respective Jurisdiction.

Hi
A partition agreement has to be signed by all the family members if all the family members are major's at the time of partition settlement. Even if one of the family member has NOT signed the partition agreement, the partition agreement is NULL AND VOID.
If any of the family members are minor's at the time of partition agreement, the minor's can challenge the same with in 3 years from the date of they coming to know of partition agreement.

First of all by your words it states that you are one of those two sister,if am correct,and if you're brother not having any legal hier you can claim whole property, orelse you eligible for only remaining leftover property
