Seller forcing to pay Road tax of commercial vehicle

We are a Pvt Ltd company registered in West Bengal purchased a 10 wheel Hywa from a person in Jharkhand in Aug'14 on agreement which was notarised in Jharkhand. As per the clause of the agreement the seller was supposed to handover us (i) NOC from financier under whom the Hywa was hypothecated and (ii) Transfer of ownership at the time of purchase. We paid all amount as per purchase agreement. But we have't got the above two documents yet despite of our email to the seller. Now the Hywa is in scrap condition and we incurred huge losses and therefore unable to pay road tax and penalty to the

need more detail to suggest you
like what was the date of agreement and mode of payment and how long you used the vehicle and finally do you want to take legal action against the opposite party

Venerated Sir,
As per your question I wish to inform you that it is the duties of the Seller to sell freehold property to the buyer and if any encumbrances and liabilities over the said property during the time of making agreement then that agreement is itself void agreement. If the seller is promised to perform his part and in future he is denying to perform his part then you can also file a suit under Specific Performance of contract for performing his part and also raised loss due to non performance of Seller.. If he hide about the property during the time of making the agreement then it is also a void contract... You can file a case against the Seller for non performance of contract.... need more information then call me..

you need to send a legal notice to the seller in regards of handing over the documents along with losses due to non delivery of
said documents.
