Relatives used our survey no. without our permission what to do

06-Jul-2023 (In Civil Law)
Hi, we have inherited an ancestral property with legal document. Recently our relatives had sold their ancestral property and registered it with their survey number as reference. After few months they had made some changes in the registration and re registered again. the correction they have made is that they changed the survey no. But the survey number they have entered is from our document. I had come to know this when i had searched for encumbrance certificate in registrations website. And when i had further inquired i came to know that one of those people had come to my mother when we were not there and took a copy of our document saying that someone is encroaching our land and that they need to show the document. my mother is ignorant about these land dealings and gave them a copy. what i am make out of this is that the buyer could not get a loan on his plot because he could not provide proper link document, so they had planned this and re-registered it with our document. what can i do ?

Hi
You should file a suit for declaratory title and possession in a civil suit OR
You can file a suit for cancellation of registered sale deed/partition deed in the court on the grounds that the survey numbers mentioned in the sale deed/rectification deed is factually incorrect and at the same time ask the court for interim injunction restraining the opposite parties from creating any encumbrances on the sale deed.

you can file a partition suit and in it you can also seek declaration to nullify the documents which were executed without your signature with regard to the share you are entitled and then you can also obtain injunction to eradicate further transfer of property
