Registration of construction on empty roof

Sir we have already constructed building only ground floor tht belongs to me and my brother and now i ve planned for construction of 1st floor on the empty roof is it possible to for my brother to register the empty roof to my name before theconstruction?

There is no such thing like registering the empty roof to one's name - either to you or to your brother. As I understand from your narration, you and your brother are joint owners of the site and the constructed building. Any changes you have to make regarding the ownership of the property, both of you should do it jointly.

Once the property stands in a person's name, you cannot register each floor in separate name unless you have got the khata bifurcated. If the property is in joint name, then both person's consent is required. So if you want to build on the roof, and you have the necessary permissions from local authorities, you will need the permission of the property owner. If you are the sole property owner, then your brother cannot register it.
