Regarding Succession Certificate

My aunt died without making any will. She was unmarried and now only successor she has is her mother and married sister. she has one flat on her name which is her self earned property..do i need to get succession certificate to transfer that flat on her mothers name? She was Hindu so can I apply for succession certificate under Indian Succession act or do i need to apply under Bombay regulation act?

The certificate is granted by a competent civil court after you file an appropriate petition mentioning the details of legal heirs, property etc.

The court will thereafter issue notices to all the legal heirs to attend the proceedings. You can get the notice served quickly by getting the vakalatnamas of all the legal heirs filed in court.

By this manner your can save time in service of notice. The rest will be done as per the procedure of the hon'ble court.

If Government demands from you then apply for succession certificate.First you apply for compassionate appointment.Therby your claim for appointment shall be considered ae early. Therefore submit application with affidavit and death certificate of your husband to Govt.Office.

Sorry for the permanent voud happened to you mam.Kindly get the legal documents prepared to claim for the pension or other relevant legal assets and rights of your spouse whom you have lost recently.Being the legally wedded life you automatically might become the legal heir but in case you are having other legal heirs and dependants in family as well that is his children born out of your wedlock and his parents or unmarried sister or younger siblings who are not independent can also claim their legal rights under Indian Succession Act.

Where the nominee is appointed there i no need of succession certificate. You can directly apply and get benefits. Nominee is appointed for such contingencies to save from tedious procedures and smooth transition.

Mare Hue aadami ke bank account se ATM dwara Paisa nikalna Ek Apradh hai . Aise mein lajmi hai ki aap pahle court dwara succession certificate obtain kar len aur uske bad hi vah Bank Mein prastut Kar legally sare funds ko Apne account mein claim Karen

The insurance company point of view they will consider only what is mentioned in the policy document since your husband mentioned the nominee name is other person the insurance company will give the amount to nominee only but you can make a representation to the insurance company stop paying the amount for making some disturbance. then your relatives will compare settlement.
