HI I M FROM WEST BENGAL ,I WOULD LIKE TO KNOW FOR GETTING SUCCESSION CERTIFICATE TO CLAIM MY EXPIRED FATHERS' GRATUITY AMOUNT OF RS 70000/- HOW MUCH STAMP DUTY I HAVE TO PAY.

For claiming a sum of 70,000 INR the client would be required to pay an estimated sum of 4120 INR as court fee.

Usually, organisations do not ask for Succession Certificates for such a small amount. They usually take a couple of Affidavits in their own formats and ask the persons to get those affidavits done and affirmed and thereafter they release the amount. But in case they do ask for a succession certificate it is suggested that you -
1. File a PLA Application 
2. Affidavit of Assets - in this you can include everything you wish to include.

Once the Petition is filed, the Court makes the assessment and provides the exact stamp duty payable which can be payable through Court Fee Stamps (which look similar to Non-Judicial Stamp Papers).
Presently in many cases, online payments are also accepted.

It is 4% of the property value from Rs50001 to Rs 2,00000.Please check whether nomination in accordance with the Payment of Gratuity Act is available in your house.As per the statutory provisions,a copy of the nomination document should be in your deceased father's custody.If the same is not available , immediately contact the employer and ask for the same in writing giving a time line.If the same is also not available with the employer, intimate the position to the concerned Assistant /Deputy Labour Commissioner (being the controling authority under The Payment of Gratuity Act) and act per his advice.If succession certificate is at all required for receiving payment of Gratuity ,obtain the same after including other properties and not in piece meal manner.For further clarification, contact me through lawRato.

as per Norms you shall pay On the 1st ten thousand rupees--------- 3% (10,000/-= Rs.300/-) On the next forty Thousand rupees ------------ 4% (40,000/-= 1600/-) On next fifty thousand rupees ------------ 5% (in your case 70,000/- -- 10,000/- + 40,000/- i.e., remains 20,000/- ----- 5% (20,000/- = 1000/-). In total 10,000/-= 300/-; 40,000/-=1600; 20,000/- = 1000/- i.e., Rs.2900/- will be charged as Stamp Duty.
