First try to collect all your Document from Present Lawyer and search a New Advocate. Ask your present advocate to give you "No Objection Certificate". In Case, if he refuse to provide any NOC, you can make a application in the concerned Court to withdraw the Vakalatnama.

Dear Sir,
You have not mentioned any of the facts where you have filed the case, subject matter etc. albeit you can tell your lawyer that you do not wish to continue further with him and seek an Noc from him to that effect. Thereafter, you can engage some one else in the matter.

you can take back that amount since no work is done by him and taken the advance amount. For that u you can give him notice through other lawyer and take his NOC to assign the case to new lawyer. Regards
