Petitioner not filing rejoinder,options available to respondents

in a probate case in district court, the adv. of petitioner is not filing their rejoinder since last three court dates. The magistrate expressly mentioned in her last order that the petitioners adv. is reqd to file rejoinder same day and serve copy of it to the respondents at their residence. But he didn't do so yet. What are the respondents options ?

Hi , in your case talk to your advocate and tell him for exparte judgement as three dates are gone now.

in your case, you should act more aggressively for the judgement and these delay should be on cost to petitioner.

Rejoinders are not mandatory in character but can be filled with leave of court.if repeated adjournments are sought the same can be compensated with cost and the court is not powerless to close the right to file rejoinders
