Pending case in high court can the property be still sold
15-Aug-2023 (In Civil Law)
There is a pending case in High court of Telangana, the court gave order to look into matter to District Collector and other parties. The matter is about Land, that got registered as GOVT Land. in Simple, the land records needs to be rectified. So elders got the order for rectification of land records. The matter is still pending at DC office( District Collector and Land settlement Commissioner office). My elders now, trying to sell the land without my knowledge and entered into agreement for such act. I have checked with Official Records of Land, they still show GOVT land. My question is the agreement such made by elders with third party is it legally correct and possible to register the land further. What options do I have now?
As you said there is pending case before Hon'ble High Court of Telangana so its not possible for sell the properties as the case is still pending so for this you can approach before appropriate procedure
there will list of prohibited properties with the registrar of the district and only if the property is not noted in that list only he can register even if as per the circular of the registration department in the combined state 2010 that the property involved in the legal dispute only after 6 months after such disposal
HI
legally if the property is shown as government land, then elders cannot sell the land to any person with or without your knowledge as the property will be in prohibited register of sub-registrar.
So, you will need to wait for the order of District collector and land settlement commissioner office before making any sale.
Also if you are not a party in the High court case, you should implead yourself in the case as other wise you will loose out on the case
