order 23 rule 3 want to cancel compromise and fight case on merit

- Where it is proved to the satisfaction of the court that a suit has been adjusted wholly or in part by any lawful agreement or compromise in writing and signed by the parties, decree not passed by counse ... i want to cancel the cropromize and case come o merit .how it possible.

Firstly, have you signed the compromise deed? Secondly, if you need proper advise, you will have to show the papers, so we can give you a proper advise as giving advise like this won't benefit you the way it should in the long run. so I advise you to come to office with documents and help us give you proper advise.

You may do this by challenging the compromise decree passed by the relevant Court by filing a petition under proviso to Rule 3 of Order 23. Thus, by filing this petition you can question the compromise decree passed by the Court which recorded satisfaction in your case and passed the compromise deed. Alternatively, you may prefer an appeal under Section 96 (1) of the Code.
