Sir, first of all you did not mention that you are married under which law. However it is possible to get a divorce if you are not staying with your wife for more than one year. Yes you need to file a suit for divorce. If you both are agreeable for judicial separation you may seek for mutual Divorce and if not then you need to contest the suit but it take some time.

If you are deserted by your wife for more than two years continuously before filing divorce suit then you can get divorce on that ground but you have to prove that you are not a consenting party for that and your wife has deserted you voluntarily.

MY OPINION THAT i have follow your submission and i say that you are not staying with you legitimate wife last 5 years and that is why it is proved that you have separated from your wife last 5 years so according to Hindu marriage act, you have many scopes to divorce in different ways with your wife, you can move mutual divorce and /or you can file divorce petition against your wife.
