Not allowed to vote in RWA election as subscription fee not paid

07-Jan-2023 (In Civil Law)
The elections are due and the current RWA has put a clause that only those people can vote who are paying monthly subscription for the last 3 months. We want to know that is there any way that all persons in the society can vote irrespective of the subscription amount paid by the flat owner. This is democratic country and every body has right to vote.

Hi
If the regulations of the RWA state that the voter list would consist of those residents who have paid their subscription, you can not object to it.
Although you have a right to vote but this right can be put to reasonable restrictions as in this case it is payment of subscription.

Move to the High Court by way of a writ petition as soon as possible and obtain an interim order in your favour. Once you get an interim order in your favour, you may be allowed to vote by the Court. The issue of pending fee could be decided afterwards.
